By accessing and using BlackTop ("the Platform"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our Platform. We reserve the right to update these terms at any time, and continued use of the Platform following any changes constitutes your acceptance of the revised terms.
BlackTop provides a platform for basketball players to find courts, join leagues, and track game statistics. You agree to use the Platform only for lawful purposes and in a manner consistent with these terms. You must be at least 13 years of age to use the Platform. Users under 18 must have parental or guardian consent. We reserve the right to suspend or terminate accounts that violate our community standards.
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. BlackTop is not liable for any loss or damage arising from your failure to comply with this security obligation. You may not create multiple accounts or transfer your account to another party.
You agree not to: (a) use the Platform for any unlawful purpose or in violation of any regulations; (b) harass, abuse, or harm other users; (c) post false, misleading, or defamatory content; (d) attempt to gain unauthorized access to any part of the Platform; (e) use automated tools, bots, or scrapers to access the Platform; (f) interfere with or disrupt the integrity or performance of the Platform; (g) impersonate any person or entity. Violations may result in immediate account termination.
All content on the BlackTop Platform, including but not limited to text, graphics, logos, images, and software, is the property of BlackTop or its content suppliers and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
To the fullest extent permitted by law, BlackTop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.
We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by posting a notice on the Platform or sending an email to registered users. Your continued use of the Platform after such notification constitutes acceptance of the updated terms. We encourage you to review these terms periodically to stay informed of any changes.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in New York County.
